Booking Agreement

The “Company” refers to Oil Nut Bay Property Rentals Limited. The “Client” refers to the party requesting this reservation.

Deposits and Payments

A deposit equal to 50% of the total (inclusive of the government tax and fees) is due at the time of booking. The balance of the rate is due no later than 30 days prior to the arrival date (60 days prior for groups of 3 or more suites/villas and 90 days prior for all festive bookings). For reservations made less than 30 days prior to arrival (60 days for groups of 3 or more suites/villas and 90 days prior for all festive bookings), a 100% deposit is due at the time of booking. The Company reserves the right to cancel the booking if any payment is not received when due hereunder, and in this event, the Client will be deemed to have forfeited the Deposit. Payment can be made by ACH, wire transfer or credit card.

Cancellation Policy

Client is strongly urged to obtain insurance for protection against certain risks associated with travel, including but not limited to Client’s inability to complete the reservation contemplated by this Booking Agreement. Any cancellations or requests for changes to the booking (such as date changes or changes in the number of persons in a group) must be made in writing.

VILLAS & SUITES
  • 31 days before arrival: a full refund of the 50% deposit will be granted
  • 30 days or less before arrival, no shows and early departures: will be charged at 100% of total reserved nights per villa
GROUPS OF 3 SUITES AND VILLAS
  • 61 days before arrival: a full refund of the 50% deposit will be granted
  • 60 days or less before arrival or no shows and early departures: will be charged at 100% of total reserved nights per suite & villa
FOR ALL SUITES, VILLAS AND GROUP FESTIVE BOOKINGS INCLUSIVE OF EITHER DECEMBER 25 OR DECEMBER 31
  • 91 days before arrival: a full refund of the 50% deposit will be granted
  • 90 days or less before arrival or no shows and early departures: will be charged at 100% of total reserved nights per villa

Construction Noise

The Client acknowledges and accepts that the rental villa may be located within the vicinity of construction activity and that noise from such activity may be heard from the villa during working hours.

Resort Policies

A 10% Government Hotel Accommodation Tax and 10% Resort Fee are applied to all suite and villa rates. An 8% Service Charge is added to all suite and villa rates and all resort services. An 18% Service Charge is added to all food and beverage related charges.

Check-In and Check-Out Times

Check-in: 03:00 pm Check-out: 10:00 am Oil Nut Bay facilities are available for early arrivals and late departures.

Rate Inclusions

SERVICES AND VILLA AMENITIES
  • Electric Cart(s) for Use During Guest Stay, Daily Housekeeping, Personalized Concierge Service, Cell Phone for Local Calls, Wi-Fi and Printing, Coffee & Tea Replenished Daily, Yoga Mats
  • For Halo and the Wings Villas only, rates include Chef Services, available twice for a four-night stay and three times for a seven-night stay. The Chef Service covers the culinary expertise and preparation by our chef (8 hours/2 Meal periods) plus one server (2 hours each meal period). Food and beverage (i.e. ingredients) are not included in the Chef Service and will be billed separately.

Transfers

Upon arrival at Beef Island Airport, a representative will greet and usher you to Trellis Bay ferry dock (2-minute taxi). From there, it is a 35-minute ferry to ONB. This taxi and ferry transfer to Oil Nut Bay is $500.00 for groups up to 4 passengers, $600.00 for groups with 5-8 passengers, $700 for groups with 8-12 passengers and $900 for 12 or more passengers one way. To ensure transfers to and from Oil Nut Bay, please communicate your travel details to the Oil Nut Bay Concierge in advance. If arriving into Virgin Gorda, from another island or if helicopter transfer is preferred, our Concierge Team can assist with the arrangements. Cost of transfer will be conveyed upon confirmation of arrival details. VIP Arrival and Departure Services are available if flying in/out of Terrance B. Lettsome International Airport (EIS). Please inquire with our Concierge Team for pricing and booking.

General Terms & Conditions

The below Terms & Conditions are applicable to the Client’s stay and are hereby incorporated into this agreement by reference. No modifications to the Terms and Conditions shall be valid unless expressly accepted and confirmed in writing by the Company.

ENTIRE AGREEMENT

This Agreement, along with the Terms and Conditions, Liability Waiver, Release & Indemnity shall constitute the entire agreement, and supercedes any previous representation, discussions or agreements, whether oral or written.

In consideration of being allowed to partake in activities and use the facilities at Oil Nut Bay, I hereby personally assume all risks for any harm, injury or damage that may befall me while on the Oil Nut Bay premises. I further release, exempt and hold harmless the released parties from any claim or lawsuit. I expressly assume all financial responsibility for the full and complete cost of any damage to or loss of property during any activity at Oil Nut Bay.

I have carefully read this agreement and fully understand its contents. I am aware that this is a release of liability and a contract between myself and the Company and sign it of my own free will. I agree to adhere to the terms stated herein as a condition of my use and the use of my family, guests, and invitees of this vacation property. The signatory below accepts responsibility for all monies owed under this Booking Agreement.

THE PARTIES

Hereinafter, the “Client” refers to the person signing the Booking Confirmation and this Booking Agreement. The Client’s signature shall constitute acceptance of the following booking conditions on behalf of the Client and every guest on whose behalf he/she has the authority to sign. The “Company” refers to Oil Nut Bay Property Rentals Limited. The “Owner” refers to the owner of the Villa. (together, the “Parties”)

THE AGENT

The Company acts as an agent for the Owner in making arrangements for the useof the Villa and any services that might, from time to time, be agreed upon by the parties. With regard to additional services, agreements shall be made between the Client and the provider of said services upon such terms as shall be agreed upon between them.

THE AGREEMENT

This Booking Agreement shall not become binding until the Company has received the deposit and the duly signed Booking Agreement from the Client. The Company reserves the right to cancel the reservation with no refunds if the signed Booking Agreement is not returned prior to the Client’s arrival dates.

SECURITY DEPOSITS

The Client is required to provide the Company with a valid credit card number as collateral for any loss or damage to the Villa or its contents during the time of occupancy of the Client. The Company reserves the right to charge the Client’s credit card for any damage or lost items. The Client will be notified before any charges are applied to his/her credit card. An additional cash deposit may be required as collateral for any telephone and/or miscellaneous charges not included in the rates. The cash deposit, if any, shall be held by the Company as collateral for any unpaid telephone charges made during the time of the Client’s stay at the Villa. The cash deposit shall also be held as collateral for any other costs incurred during the time of the Client’s stay at the Villa that were not explicitly included in the rate. Please note that it is possible for a cash deposit to be held for up to six months following the Client’s departure from the Villa.

PETS

No pets are allowed in the rental villa without the prior consent of the Company. No pets are allowed at the Beach Club or other resort facilities at any time.

INAPPROPRIATE BEHAVIOR

The Company maintains the highest standards of conduct to ensure a respectful and enjoyable experience for all guests and residents. The following activities shall be considered inappropriate behavior and may result in immediate removal from the property without refund: public nudity, excessive public intoxication, roughhousing, disorderly or disruptive conduct, wild or excessively loud parties, or any other behavior that may reasonably be deemed a nuisance or disturbance to other guests, homeowners.

ON-SITE MEDICAL CLINIC

Your safety and well-being are important to us. Medical and emergency services available at the property are provided solely by an independent third-party service provider (the “Provider”), not by the Company or its staff.
While our team may assist with coordination, such as helping you contact the Provider or arranging transport, the Company does not supervise, direct, or take responsibility for any medical care provided. The Provider operates independently and is solely responsible for all clinical and operational aspects of its service, including transfers to medical facilities in and outside of the British Virgin Islands. The Provider is not an agent, partner, or contractor of the Company, and the Company does not accept any responsibility for the acts or omissions of the Provider or its personnel.
Some Company staff members are trained to act as first responders in an emergency. However, they are not medical professionals, and their role is limited to offering non-clinical support, such as initial response, comfort, or assistance until medical help arrives. By staying with us, you agree that the Company and its staff, directors, officers, agents, contractors, affiliates, subsidiaries, or parents are not liable for any actions or omissions taken in this limited role, or for any corresponding outcomes, including in situations involving negligence or gross negligence.
The Company operates entirely independently from the Provider and is not responsible for the Provider’s personnel, services, or outcomes.

DIETARY RESTRICTIONS AND ALLERGIES

The Company offers a bespoke in-villa dining experience tailored to each guest’s preferences. To ensure the highest level of safety and service, the Client is kindly requested to notify the concierge in writing of any food allergies or dietary restrictions no less than 24 hours prior to any scheduled meal or dining service. While the Company will take reasonable steps to ensure that the ingredients do not come into contact with allergens, this is not guaranteed, particularly because the Company obtains provisions from third party suppliers over whom the Company has no direct control.

Please note that should the Client choose to dine at Nova, The Beach Club, Oil Nut Bay Market & Coffee Shop, or any other food and beverage outlets operated on or near the property, the Company cannot guarantee that menu items will be free from contact with potential allergens, even when such ingredients are not listed in the dish description. If the Client has known food allergies or sensitivities, he/she is advised to exercise caution and take all necessary personal precautions.

By accepting these terms, the Client agrees to release, indemnify, and hold harmless the Company, including its affiliates, parent and subsidiary entities, employees, agents, and contractors, from any liability, claim, or loss arising from allergic reactions, foodborne illness, or other dietary-related issues experienced during their stay or participation in any food-related services provided.

SMOKING

Smoking is strictly prohibited inside and around the Villas. A minimum penalty of $500.00 will be imposed for any evidence of smoking in and around the Villa including, but not limited to smell, discoloration, or burn marks.

PERSONAL PROPERTY

The Company is not responsible for any loss or damage to personal property belonging to the Client and/or his/her guests.

USE OF VILLA

The Client may not use the rental villa for any purpose other than that of a private residence for the accommodation of the Client and his or her guests unless otherwise agreed upon in writing by the Company. The Client shall not engage in any activity or practice that may be or become a nuisance or annoyance to the Company, the villa owner or the occupants of adjoining land or that might invalidate any insurance policies in effect for the rental villa. The Client must inform the Company how many individuals will be staying at the rental villa during the reservation period. If the Client intends to host a social event such as a wedding or party, it is required that the Company is notified prior to the Client’s arrival at Oil Nut Bay. The Client shall not sublet or assign the rental of the rental villa.. A valid driver’s license is required to operate a motor cart at Oil Nut Bay.

TIDINESS AND DAMAGE

The Client shall inspect and ensure, within four hours following check-in, that the rental villa and all furniture, fixtures, golf carts and effects are in good order and condition and shall promptly inform the Company of any damage caused to the rental villa or its contents during the reservation period. The Client shall incur all charges for any such damage and for any missing items as determined by the Company.

SUBSTITUTION

In the event that the rental villa changes ownership or is unavailable, out of order, or deemed substandard by the Company for any reason, the Company reserves the right to either: (a) substitute the rental villa with comparable accommodation; or (b) CANCEL the reservation and refund the full deposited amount.

THE COMPANY’S RESPONSIBILITIES AND EXEMPTIONS

The Company does not accept any responsibility for the acts or omissions of the Client, the villa owner or any other third parties. The Company shall not be liable for any neglect, default, or failure on the part of the villa owner, its servants or representatives.

ISSUES DURING STAY

The Company must be alerted by Client prior to departure of any issues during stay.

DISPUTES

This agreement shall be governed by the laws of the British Virgin Islands. Any dispute arising out of or in connection to this agreement shall be subject to arbitration, in accordance with the BVI International Arbitration Centre Arbitration Rules 2021 (or whichever rules supersede/replace said rules).  There shall be a single arbitrator, who shall be a senior lawyer of not less than 10 years post qualification experience, or retired judge of the Eastern Caribbean Supreme Court, selected through mutual consent. If there is no agreement as to the Arbitrator, the Registrar of the BVI International Arbitration Centre shall choose the arbitrator. The Parties further agree that any dispute arising under or in connection with this Agreement shall be treated as strictly confidential. Neither party shall disclose the existence, content, or outcome of any such dispute to any third party without the prior written consent of the other party, except as required by law or as necessary to enforce a legal right. The Client is estopped from disputing ownership of any property claimed by the Company as its own.

INDEMNIFICATION

The Client agrees to release the Company and the villa owner from, and to indemnify and hold harmless the Company and the villa owner against, any and all claims, demands, fees, causes of action, liability, loss, damages claims, injury or death, costs and expenses, including attorney fees by whomsoever made, arising out of or connected in any way with, directly or indirectly, the Client’s use of the rental villa. The Company shall be deemed to include its members, owners, officers, directors, employees, agents, representatives, successors and assigns, and the Client shall be deemed to include the Client’s invitees, employees, agents, successors and assigns and independent contractors.

GENERAL LIABILITY RELEASE

Client hereby covenants and agrees that neither the Company nor any of its affiliates, subsidiaries, employees, officers, agents, or assigns (hereinafter “Released Parties”), may be held liable or responsible in any way for injury death or damages to any person that may occur as a result of Client’s participation in any land or water activity at Oil Nut Bay. The Client understands that the activities the Client may engage in while at Oil Nut Bay involve certain risks which may include but are not limited to:

  • Collision with other participants, watercraft, land craft or other objects
  • Client’s physical ability, ability to operate equipment and/or ability to swim
  • Exposure to the elements including sunburn, heatstroke, sun poison, and/or dehydration
  • Present of animal, insect or marine life
  • Equipment failure or operator error
  • Changing conditions including water currents, waves, wind, weather, and storms

In consideration of being allowed to partake in activities and use the facilities at Oil Nut Bay, I hereby personally assume all risks for any harm, injury or damage that may befall me while on the Oil Nut Bay premises. I further release, exempt and hold harmless the Company, its affiliated entities and the owner of the rental villa from any claim or lawsuit. I expressly assume all financial responsibility for the full and complete cost of any damage to or loss of property during any activity at Oil Nut Bay.

I have carefully read this agreement and fully understand its contents. I am aware that this is a release of liability and a contract between myself and the Company and agree to it of my own free will. I agree to adhere to the terms stated herein as a condition of my use and the use of my family, guests, and invitees of this vacation rental property. I accept responsibility for all monies owed under this Booking Agreement.
